The man behind the wheel of the Fedex truck, involved in a rolling battle with a school bus in Lakewood on September 14, now faces an aggravated assault charge filed by township police.

Sigmund Winiavski, 48, of Maple Shade, was released on his own recognizance to await a court appearance, according to township police. Winiavski and bus driver Morris Wilder, 68, of Lakewood, each were cited for numerous road violations.

Video of the incident led investigators to the conclusion that Winiavski tried to force the bus off the road as it was engaged in illegally passing him.

Police said that the absence of contact or physical injuries, normally, would categorize the charge as simple assault. However, Wilder's circumstance of carrying out his responsiblities as a school bus driver raised the allegation to aggravated assault.

Winiavski's traffic citations included delaying traffic, failure to maintain a lane and careless driving. Wilder was ticketed for failure to maintain a lane, improper passing and careless driving.

Jay's Bus Service dismissed Wilder shortly after the incident.

Detective Peter Aakjer and Traffic Safety Sergeant Frank Work led the investigation.
