Contest Rules

The Sharing the Gift of Life contest (the “Contest”) is hosted by Townsquare Media Monmouth-Ocean, LLC, specifically, radio station WJLK, 94.3 The Point, (hereinafter: the “Contest Organizers”).  The purpose of this Contest is to provide a single individual with the gift of assisted reproductive care (the “Grand Prize”, as defined in Section 6 of these contest rules).  To accomplish this, Contest Organizers will work with Reproductive Medicine Associates (“RMA”) of New Jersey (“Sponsor”).  RMA of New Jersey has offices located in Basking Ridge, Eatontown, Englewood, Freehold, Marlton, Morristown, Princeton, Somerset, Springfield, and West Orange, New Jersey (https://rmanetwork.com/our-locations/rma-new-jersey/).

The Contest will run from June 20, 2022 and conclude on or about September 1, 2022 after the Grand Prize Winner has been announced by Contest Organizers (“Sweepstakes Period”).  As noted in Section 2 below, all contest entries and registrations must be received before July 17, 2022 at 11:59 p.m.

 

  1. ELIGIBILITY

Sweepstakes is open to legal U.S. residents of the Ocean and Monmouth County listening areas, as defined by Nielsen, Inc., and who are between 25 and 44 years of age.  Employees of Contest Organizers, its affiliated radio stations and their respective affiliated and subsidiary companies, partners and members of the immediate families or households of such employees (“Excluded Individuals”) are not eligible.  Additionally, immediate family members of the Excluded Individuals are not eligible to participate in the Contest.  For the purpose of these Contest Rules, “immediate family” includes: father, mother, brothers, sisters, children, legal or common-law spouse and individuals with whom such employees, agents and representatives reside.  Void where prohibited.

  1. HOW TO ENTER

Go to https://943thepoint.com/ and navigate to the WJLK contest webpage.  Complete all registration fields required (full name, email, phone number, home address, and date of birth).  All registrations must also be accompanied by a short essay which explains why you are entering the contest, specifically, your personal journey in trying to start a family and why you would like help from RMA in this process.

  1. TERMS OF ENTRY

Each essay submitted as part of the registration process must be original and must be created solely by the entrant.  Essays may not contain any material that is disparaging, defamatory, threatening, indecent, violent, obscene or offensive, or that promotes a political agenda, violence, bigotry or discrimination.  Essays shall not violate any right of any third party.  Essays must not contain any material that Contest Organizers, in its sole discretion, deems inappropriate for public viewing and/or display.  By submitting your essay (your story), entrant represents and warrants that: (1) he/she has complied with all of the foregoing requirements and has obtained all permissions, licenses and consents that are necessary for the submission of entrant’s essay; (2) that use of the information written in the essay is permitted pursuant to these Contest Rules; and (3) that entrant verifies compliance with all of the foregoing requirements.

Incomplete entries or registrations submitted without an accompanying essay will be deemed ineligible.

No purchase necessary.  You must comply with the eligibility criteria set forth above.  Only one entry will be considered per person.  Entry/registration does not guarantee the Grand Prize.  All prize claims are subject to verification of the entrant’s eligibility and compliance with the Official Rules.  If you are deemed the Grand Prize Winner, but found to be ineligible, you will be disqualified from the Contest and any prize awarded to you will be forfeited.

  1. HOW TO PLAY

Submission Period.  Beginning Monday, June 20, 2022, and continuing each day up and through 11:59 p.m. on July 17, 2022 (the “Submission Period”), listeners are invited to enter the Contest as an entrant in accordance with the criteria set forth in Sections 2 and 3 above.  Upon conclusion of the Submission Period, all entrants, subject to eligibility, will be advanced to the “Voting Period”.

Voting Period.  During the Voting Period, each entrant’s essay will be displayed on the WJLK contest webpage[1].  Beginning July 18, 2022 at 10:00 a.m. EST, and continuing through July 25, 2022 at 12:00 p.m. (the “Voting Period”), the public will have an opportunity to read, review, and cast their vote[2] for one (1) entrant, per day, who they feel is the best and most deserving individual to receive the Grand Prize, as defined below in Section 6.  At the conclusion of the Voting Period, the three (3) entrants with the highest number of votes (each a “Finalist”) will be advanced to the final “Winner Selection”.

  1. WINNER SELECTION

On or about July 26, 2022, Contest Organizers will share each Finalist’s registration and personal essay with RMA for final review and Winner Selection.  At this time, Contest Organizers will notify each entrant that they have been selected as a Finalist.  Each Finalist will then be asked to provide additional information (as noted below) to RMA for thorough review.  On or before September 1, 2022, taking into consideration all of the information collected (registration essay and subsequent personal and health information), RMA, in its sole and absolute discretion, will choose one (1) Finalist who they deem to be the most qualified candidate for assisted reproductive care[3].  This Finalist will be deemed the “Grand Prize Winner”.  Grand Prize Winner will be notified by Contest Organizers (via telephone) that they have been selected by RMA to receive the Grand Prize.

Additional information to be requested by RMA for each Finalist shall include, but will not be limited to: how did you hear about the contest, who is your employer, do you have health insurance, do you have insurance coverage for infertility, have you ever been convicted of a crime (if yes, details should be disclosed), annual income, partner's annual income, number of individuals in the household, are you planning to use an egg donor, are you planning to use donor sperm, are you planning to use a surrogate, number of previous IVF cycles, name/phone of the fertility clinic, official lab results (must include ovarian reserve testing, day 3 FSH/LH and estradiol, antral follicle count, AMH, saline sonography or HSG results, semen analysis, and body mass index).

  1. GRAND PRIZE AND PRIZE TERMS

The Grand Prize Winner shall be awarded the following services which are to be provided directly to the Grand Prize Winner and directly from RMA of New Jersey.  Such services shall collectively be referred to, for purposes of this Contest, the “Grand Prize”:  standard office visits typically made in connection with standard assisted reproductive care; endocrine monitoring; ultrasound monitoring; semen wash + preparation; oocyte retrieval procedure; ICSI; assisted hatching; extended culture; embryo biopsy; PGT-A, aneuploidy screening of up to ten (10) embryos; thawing of cryopreserved embryos; preparation for embryo transfer; and embryo transfer procedure.  Grand Prize Winner is financially responsible for the cost of embryo, egg, or sperm storage (after one year) and any subsequent fertility services.

The following services will not be awarded to the Grand Prize Winner and are not included as part of the Grand Prize:  services prior to the start of the IVF cycle; embryo, oocyte, or sperm re-cryopreservation; yearly embryo storage; medication; anesthesia; donor oocytes; donor sperm; and gestational carrier fees/services.

The approximate total retail value of the Grand Prize is twenty thousand dollars ($20,000.00). 

Value of the Grand Prize shall be provided directly by RMA to the Grand Prize Winner.  No refunds or exchange in services will be disbursed to the Grand Prize Winner.  Value of the Grand Prize must be used within twelve (12) months from the date on which Finalist has been notified (whether it be by Contest Organizers of RMA) that Finalist has been selected as the Grand Prize Winner.

All information provided in the registration process and all information provided to RMA as part of the Winner Selection process must be accurate and truthful.  If an entrant is deemed to be the Grand Prize Winner and awarded the Grand Prize and it is determined that the information provided was falsified, the Grand Prize Winner will be responsible for repaying RMA of New Jersey, in full, for all services utilized by the Grand Prize Winner to the date of discovery of such false information.

RMA cannot guarantee a pregnancy or a successful delivery.  If there are any changes in insurance status, income, or other significant health information prior to the Grand Prize services listed above, or at any time throughout the process of services rendered as part of the Grand Prize, you must contact and notify RMA immediately.

Grand Prize is not transferable or exchangeable for any other prize or equivalent prize.  An individual may only win once during the Sweepstakes Period.

In consideration of the receipt of the Grand Prize, Grand Prize Winner agrees to be solely responsible for any and all taxes and/or other fees, including, but not limited to, any federal state or local income taxes, that are or may become payable as a result of participating in the Contest and/or receipt of the Grand Prize.  If necessary, a 1099 will be provided to Grand Prize Winner by RMA.

  1. CONCLUSION OF CONTEST

The Contest will end promptly upon conclusion of the Sweepstakes Period after a Finalist has been deemed the Grand Prize Winner.

Immediately upon conclusion of the Contest, Grand Prize Winner agrees to provide Contest Organizer with monthly updates on his/her journey through assisted reproductive care with RMA of New Jersey.  Grand Prize Winner agrees that the Released Parties (as defined above in Section 10) may subsequently use, for publicity and/or promotional purposes, all monthly updates, his/her first and last name, likeness, personal story (essay) and/or photograph(s) of Grand Prize Winner without any additional consideration to Grand Prize Winner beyond allowing him/her to participate in the Contest and receive the Grand Prize.

  1. HOW TO CLAIM A PRIZE

In addition to the information collected by Contest Organizers and RMA as part of the Winner Selection process, Grand Prize Winner may be asked to complete certain additional documentation as a condition of receiving the Grand Prize.  Such documentation will be emailed to the Contest Winner (by Contest Organizer and/or RMA) at the email address provided as part of the Grand Prize Winner’s registration for the Contest.  A government issued photo ID will be required when claiming the prize.

Contest Organizer’s involvement in the Contest, including involvement in execution of the Grand Prize, with the exception of monthly updates as described in Section 7 above, will cease immediately upon conclusion of the Contest.  Upon conclusion of the Contest, RMA will contact the Grand Prize Winner, after he/she has been notified of such status, to begin the process of assisted reproductive care and to set up the first in office visit.

  1. GRANT OF RIGHTS

By entering the Contest, each entrant irrevocably grants to Contest Organizer, which shall include RMA, and Contest Organizer’s parent companies, subsidiaries and affiliates, each of their respective successors and assigns and the agents and licensees of each of the foregoing (collectively, the “Licensees”) the right to use the entrant’s name, likeness, voice, biographical information, essay, and/or statements attributed to the entrant and the entrant’s essay, in perpetuity, throughout the world, in all media and formats whether now or later known or developed, including without limitation via Contest Organizer’s websites and social media and digital channels, for marketing, promotion and other commercial purposes and any other purposes, without further notice or compensation, unless prohibited by law.  Licensees shall have the right to use and display, for publicity and/or promotional purposes, monthly updates on Grand Prize Winner’s journey with RMA of New Jersey.

While each entrant’s identity will remain anonymous throughout the voting period, in the event an entrant is named a Finalist, entrant’s personal information, including his/her identity, will be shared with RMA, as noted in Section 4 above.  Entrant agrees to cooperate with RMA in their collection of data within a timely manner.

  1. RELEASE AND LIMITATION OF LIABILITY

By entering the Contest, to the fullest extent permitted by applicable law, each entrant releases and agrees to hold harmless each of the Licensees, all other companies involved in the development or operation of the Contest, all other companies involved in the provision of the prize or any component of the prize, the agents and contractors of each of the foregoing, and the directors, officers and employees of each of the foregoing (collectively, the “Released Parties”) from and against any and all claims and causes of action of any kind that the entrant ever had, now has or might in the future have, and all liabilities, damages and expenses of any kind, arising out of or relating to the Contest, the Website, participation in or entry in the Contest, the provision, acceptance or use of any prize or any component of any prize or any use of the entrant’s name, likeness, voice, biographical information and/or statements attributed to the entrant or any Submission as permitted pursuant to these Official Rules, including without limitation any and all claims and causes of action (a) relating to any personal injury, death or property damage or loss sustained by any entrant or any other person, (b) based upon any allegation of violation of the right of privacy or publicity, misappropriation, defamation, or violation of any other personal or proprietary right, (c) based upon any allegation of infringement of copyright, trademark, trade dress, patent, trade secrets, moral rights or any intellectual property right, or (d) based upon any allegation of a violation of any law, rule or regulation relating to personal information or data security. Each entrant agrees not to assert any such claim or cause of action against any of the Released Parties. Each entrant assumes the risk of, and all liability for, any injury, loss or damage caused, or claimed to be caused, by participation in this Contest or the provision, acceptance or use of any prize or any component of any prize. The Released Parties are not responsible for, and will not have any liability in connection with, any typographical or other error in the printing of the offer, administration of the Contest or in the announcement of the prize. The Released Parties are not responsible for, and will not have any liability in connection with, late, lost, delayed, illegible, damaged, corrupted or incomplete entries, incorrect or inaccurate capture of, damage to, or loss of entries or entry information, or any other human, mechanical or technical error of any kind relating to communications or attempted communications with any entrant, the submission, collection, storage and/or processing of entries or the administration of the Contest. The Released Parties are not responsible for, and will not have any liability in connection with any Act of God, war, terrorism, accident, fire, strike, lock-out or other labor controversy, riot, civil disturbance, act of public enemy, law, enactment, rule, restraint, order or act of any governmental instrumentality or military authority, or other cause not reasonably within their control that may delay or prevent Sponsor from fulfilling its obligations pursuant to these Official Rules.

  1. DISPUTES

By entering the Contest, each entrant agrees, to the maximum extent permitted by applicable law, that (a) any and all disputes, claims and causes of action arising out of or connected with the Contest or the provision, acceptance and/or use of any prize or prize component will be resolved individually, without resort to any form of class action (Note: Some jurisdictions do not allow restricting access to class actions. This provision will not apply to entrants who live in such a jurisdiction); (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorneys’ fees; (c) under no circumstances will any entrant be permitted to obtain any award for, and each entrant hereby waives all rights to claim, punitive, special, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses, and (d) each entrant’s sole and exclusive remedy with respect to any and all disputes, claims, and causes of action arising out of or connected with the Contest will be an action at law for the recovery of monetary damages only, and in no event will the entrant have the right to enjoin or otherwise interfere with the exercise by the Licensees of any of the rights granted in these Official Rules or terminate or rescind any of the rights granted in these Official Rules. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the respective rights and obligations of the entrants and Sponsor in connection with the Contest shall be governed by, and construed in accordance with, the laws of the State of New York without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than the State of New York. Any legal proceedings arising out of this Contest or relating to these Official Rules shall be instituted only in the federal or state courts located in New York County in the State of New York, waiving any right to trial by jury, and each entrant consents to jurisdiction therein with respect to any legal proceedings or disputes of whatever nature arising under or relating to any of the foregoing. In the event of any conflict between these Official Rules and any Contest information provided elsewhere (including but not limited in advertising or marketing materials), these Official Rules shall prevail.

  1. GENERAL TERMS AND CONDITIONS

By participating in the Contest, entrants agree to the following:

  • Grand Prize Winner (for purposes of this section, “Winner”) must comply with all of the rules of the Contest, including, but not limited to, any restrictions on age and/or residency, and have not committed any fraud or deception in entering the Contest or claiming the Prize.
  • Winner must affirm and represent that he/she is not an employee or agent of the participating station, Contest Organizer, or any sponsor of the Contest, including RMA, and is not a member of the same household of any such employee or agent.
  • In consideration of the receipt of the Grand Prize, Winner agrees to be solely responsible for any and all taxes and/or other fees, including, but not limited to, any federal state or local income taxes, that are or may become payable as a result of participating in the Contest and/or receipt of the Grand Prize.
  • Winner agrees to allow the participating station, Contest Organizer, and/or its designees the right to use Winner’s name, likeness, portrait, recorded voice and/or biographical material for an unlimited period of time in order to advertise, promote or publicize the participating station, Contest Organizer, and/or the products and services of any of its designees.
  • The Contest Organizers makes no warranties of any kind with respect to the Grand Prize, including, but not limited to, any warranties of merchantability or fitness for a particular purpose. Contest Organizers hereby expressly disclaims any and all such warranties.
  • Winner expressly releases the Contest Organizers, and any additional sponsors of the contest, including RMA, and their respective officers, directors, agents, parent companies, subsidiaries and employees, from any and all claims, demands and/or causes of action of any nature or kind whatsoever, whether presently known or unknown, foreseen or unforeseen, that he/she may have, or may subsequently acquire, as a result of participating in the Contest and/or receipt of the Grand Prize.
  • No purchase is necessary to participate in or win this Contest. Contests are void where prohibited by law.
  • Employees of Townsquare Media, Inc., their affiliates, subsidiaries, advertising and promotion agencies, vendors and their immediate family members and/or those living in the same household of each are not eligible.
  • The Contest Organizers are not responsible for telephone system or internet failure, or other inability of entrants to enter due to technical malfunction. This Contest Organizers are not responsible for lost, late or misdirected mail or for printing errors. No mechanically reproduced or completed entries will be accepted.
  • Listeners are only eligible to win Prizes every 30 days.
  • All federal, state and local taxes apply and are the sole responsibility of each Winner.

[1]  Entrant’s name, including any family member’s name included in your essay (spouse, girlfriend/boyfriend) will be removed so as to protect each individual’s privacy.

[2]  Only one vote per person, per day will be counted and accepted.  No mechanically reproduced voting mechanisms will be allowed.  If it is discovered that any voter or entrant used any mechanically reproduced voting mechanisms, those votes will not be counted toward the subject entrant’s final vote count and entrant may, in the Contest Organizer’s sole and absolute discretion, be disqualified from the Contest.

[3]  RMA has the right to assess and qualify a recommended candidate prior to designation of Grand Prize Winner status and prior to any such treatment.  In the event RMA finds that none of the three Finalists are qualified to receive the Grand Prize, for reasons based on their professional and medical experience, opinion, and in their sole and absolute discretion, the entrants with the fourth (4th) and fifth (5th) highest vote counts will be deemed Finalists and shall be subject to the provisions of Section 5 above with respect to document and information collection by RMA.  In the event the fourth and fifth Finalists are deemed to be unqualified, the entrants with the sixth (6th) and seventh (7th) highest vote counts will be deemed Finalists.  This process shall continue until a Grand Prize Winner has been identified.
